TULSA PERFORMING ARTS CENTER
PUBLIC WI-FI ACCESS TERMS AND CONDITIONS
This agreement sets out the terms and conditions under which wireless internet access (“the Service”) is provided free of charge to you as a guest, patron, artist, vendor, board member, volunteer, or employee of the Tulsa Performing Arts Center Trust (“TPACT”).
Your access to the Service is provided at the sole discretion of TPACT. Access may be blocked, suspended, or terminated at any time and for any reason, including but not limited to violation of this Agreement, actions that may result in liability for TPACT, disruption of access to other users or networks, or violation of applicable local, state, federal, or international laws or regulations. TPACT reserves the right to monitor and collect information while you are connected to the Service. Any information collected may be used at TPACT’s discretion, including sharing such information with law enforcement agencies, TPACT partners, and/or TPACT vendors as permitted by law.
TPACT may revise this Agreement at any time. You must accept this Agreement each time you use the Service, and it is your responsibility to review it for any changes prior to each use.
TPACT reserves the right at all times to withdraw the Service, modify the specifications or manner of use of the Service, or change access codes, usernames, passwords, or other security credentials required to access the Service.
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, INCLUDING ANY MODIFICATIONS, DO NOT ACCESS OR USE THE SERVICE.
1. DISCLAIMER
You acknowledge and agree that:
The Service may not be uninterrupted, timely, secure, or error-free;
Your device may be exposed to viruses, malware, or other harmful applications through use of the Service;
TPACT does not guarantee the security of the Service, and unauthorized third parties may gain access to your device, files, or communications;
TPACT’s ability to provide the Service free of charge is based on the disclaimers and limitations of liability set forth in this Agreement;
TPACT may block access to internet services or content it deems, in its sole discretion, to violate the acceptable use terms outlined in Section 2.
The Service and any products or services provided in connection with the Service are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind. All warranties, conditions, representations, indemnities, and guarantees — whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, quality, speed, performance, or reliability — are hereby disclaimed to the fullest extent permitted by law.
2. ACCEPTABLE USE OF THE SERVICE
2.1 Prohibited Uses
You must not use the Service to access, transmit, or receive content or communications that:
2.1.1 are defamatory, threatening, intimidating, or harassing;
2.1.2 contain obscene, profane, or abusive language or material;
2.1.3 contain pornographic or sexually explicit material;
2.1.4 contain offensive or derogatory material relating to sex, race, religion, color, national origin, age, disability, medical condition, or sexual orientation;
2.1.5 infringe upon the intellectual property or other rights of any third party;
2.1.6 may, in TPACT’s reasonable opinion, adversely affect TPACT’s operations, reputation, or mission;
2.1.7 consist of bulk, spam, or commercial solicitation messages;
2.1.8 include forged, altered, or misleading headers or origin information;
2.1.9 invade the privacy of others; or
2.1.10 are otherwise unlawful, inappropriate, or objectionable.
2.2 Copyright
Music, video, images, text, and other content available on the internet may be protected by copyright or other laws. You may not download, reproduce, distribute, or use such content unless you are authorized to do so by the rights holder.
2.3 Unauthorized Access
You must not use the Service to access, attempt to access, or interfere with computers, systems, networks, or accounts without authorization. This includes activities such as port scanning, network probing, or other attempts to bypass security measures.
2.4 Malicious Software
You must not use the Service to introduce, transmit, or distribute viruses, worms, Trojan horses, or other malicious or destructive software.
2.5 Intended Use
The Service is provided for the convenience of TPACT patrons and affiliates and is intended for personal, non-commercial use only.
2.6 Enforcement
TPACT may suspend or terminate your access to the Service at any time if it reasonably believes you have violated this Agreement, including but not limited to Sections 2.1 through 2.5.
2.7 Confidential Information
TPACT recommends that you do not use the Service to transmit or receive confidential, sensitive, or proprietary information. Any such use is at your own risk.
3. CRIMINAL ACTIVITY
3.1 You must not use the Service to engage in any activity that constitutes or may constitute a criminal offense under applicable laws in the United States or elsewhere.
3.2 You acknowledge that TPACT may be required to provide information or assistance to law enforcement or governmental authorities.
3.3 You acknowledge and agree that TPACT may monitor usage of the Service and maintain logs, including Internet Protocol (IP) addresses, access times, and associated activity.
3.4 You agree that TPACT may cooperate fully with law enforcement agencies and rights holders in the investigation of suspected or alleged illegal activity, including the disclosure of information as permitted or required by law.
4. OTHER TERMS
4.1 Limitation of Liability
Under no circumstances shall TPACT, its officers, directors, employees, agents, contractors, suppliers, or affiliates be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, unauthorized access, equipment damage, or service interruption.
4.2 Indemnification
You agree to indemnify and hold harmless TPACT and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, violation of this Agreement, infringement of third-party rights, or violation of any law or regulation.
4.3 No Partnership or Agency
Nothing in this Agreement shall be construed to create a partnership, joint venture, agency, or franchise relationship. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
4.4 Governing Law and Entire Agreement
TPACT’s performance under this Agreement is subject to applicable laws and legal process. This Agreement constitutes the entire agreement between you and TPACT regarding use of the Service and supersedes all prior agreements or understandings relating to the subject matter.
By accessing or using the Tulsa Performing Arts Center Trust’s wireless internet service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
